A pedestrian is a person on the road, outside a vehicle, except a person authorised to carry out road works and lawfully doing so.

The rule has one exception, and that exception is what is being examined: a road worker while working is not deemed a pedestrian. The logic is that pedestrian duties — crossing at the markings, not standing on the carriageway, walking on the pavement — are in complete conflict with the nature of work that requires someone to spend hours in the middle of the carriageway laying asphalt or painting markings. Instead, the legislator arranged his protection in another form: the work zone must be marked with signs and temporary devices, high-visibility clothing is compulsory, and responsibility for safety rests with the contractor.

For you as a driver the practical consequence is: within a roadworks zone, do not expect "pedestrian behaviour" from these people. They may work with their backs to traffic and never look at you. The temporary signs and cones of that zone take precedence over permanent signs, and you must reduce speed to the point of complete control.

• It brings the road worker inside the definition of pedestrian, whereas the law expressly excludes him from that definition.
